TERMS OF SERVICE

By commissioning, you agree to the following terms on process, delivery, and usage of your commission:

1. General Terms

  1. My art is in no means, in any state are to be used for any type of AI and NFT.

  2. I have the rights to refuse and/ or cancel any project, refund the money at any given time if I'm incapable to fulfill the request.

  3. Contacts should be done on Instagram, Discord, X, VGen, and Ko-Fi.

  4. I, SimL, as the artist is responsible to follow through the client's request(s), need(s) and to keep communication with the client.

  5. The client mentioned is a person/group/party that has made contact, request, and requirement(s) with me as the artist. The recipient(s) of the project result outside of client(s) per agreement are NOT considered client.

  6. The client should use the watermarked version of the art, credit and link back the Artist whenever and wherever you post it online.

  7. The Artist is allowed to record the process, display and use the commission output in portfolio unless it’s agreed upon.

  8. You may cancel the commission if I haven't started yours.

2. Payment

  1. The prices are available in IDR (for Indonesia, Vietnam, Philippine) and USD (Global).

  2. I accept Paypal for international, and QRIS for local. This may differ if you place commission through other platforms.

  3. I only accept payment after I finished the confirmed sketch.

  4. I won't continue the commission unless you pay in front. Half or deposit are available for minimum 50% of the commission total.

  5. Refunds are not available, unless I cancelled the commission or If I haven’t start beyond sketch stage. However, there will be a Kill Fee to compensate my time during sketching stage.

  6. When Paid in Half, I won’t give the finished commission until I receive the rest of the payment.

  7. The prices are included with tax except through VGen.

3. General Process

  1. The client may send as many reference as possible, either text or any visual media.

  2. We shall discuss about the commission before I proceed to sketching.

  3. I shall proceed after I confirm your payment.

  4. I will update you in each progress stage of the commission. I won’t proceed without your approval.

  5. If you do not like the update system, you may confirm to me, but I do not accept any complaint at the end process.

  6. Files will be shared through Google Drive link or through the platform you ordered from. Any given link will be available for approx. 2 weeks. Please retrieve your files before due time.

4. Deadlines

  1. The commission may take from 3-14 days or more up to the queues and/or difficulties.

  2. Tight or fixed deadline will be charged as Rush Fee.

5. Revisions

  1. Unlimited revision during the sketching stage (please be mindful).

  2. 2 medium revisions for Lining Stage.

  3. 2 medium revisions for Coloring Stage.

  4. 1 minor revision for Rendering Stage.

  5. Be mindful that major revision is only acceptable on sketching stage. Any other revisions will be charged extra.

Personal Commission Terms

  1. The commission result belongs to the client. However, the artist holds the copyright of the piece. Re-selling in any form is strictly prohibited.

  2. The reproduction of any printed media is allowed strictly within personal use only.

  3. The artist is not allowed to re-sell the illustration in any way, unless the artist has permission to do so and the illustration is a fan art from a well-known movie, games, and etc.

  4. The client should receive RGB files of the whole Illustration, the transparent .PNG of the character(s), and the watermarked version of the illustration. CMYK files can be provided by request.

Commercial Commission Terms

  1. Fan Art of any character from big franchise(s) is not available for copyright purchase.

  2. The client and artist should read and signed the agreement contract made and proofread by both the artist and the client before proceeding if there are any.

  3. The commission result is allowed to be monetized for any content creation purposes.

  4. There will be an additional fee for the copyright usage bound by agreement mentioned.

  5. The commission result belongs to the client up to limited usage per agreement. The client should pay additional fee for full copyright.

  6. Merchandizing is allowed after purchase to be used in any media, including printed, promotion, online platform and so on by client up to limited usage per agreement.

  7. The illustration(s) is allowed to be sold and used for profit per agreement.

  8. Point 4-5 would be null if the client purchased the whole copyright of the project.

  9. The artist is not allowed to share or use the illustration in portfolio without the client's permission.

  10. The artist is not allowed to re-sell the illustration in any way unless agreed upon with client

  11. When used in social media platform, the client is strongly advised to credit the Artist and may use any version of the commission result desired

  12. The client should receive RGB files of the whole Illustration, the transparent .PNG of the character(s), and the watermarked version of the illustration. CMYK files can be provided by request.

  13. The client with full copyright purchase should receive the raw/work file in .PSD/.CSP/.PROCREATE
